The Fram® Cory Mac Boat Sweepstakes (the "Sweepstakes”) is open only to legal residents of the 48 contiguous United States and D.C. It is intended to be played in the United States only and shall only be construed and evaluated according to U.S. law. Entries originating from persons located outside of the United States at the time of entry are void. Do not enter this Sweepstakes if you are not a legal resident of the United States who is residing in the United States at the time of entry.
1. Sweepstakes entry period starts at 12:00:01 a.m. EDT on September 1, 2008, and ends at 11:59:59 p.m., EST on December 31, 2008 (“Sweepstakes Entry Period”). Sweepstakes is open only to legal residents of the 48 Contiguous United States and the District of Columbia who are 18 years of age or older with a valid driver’s license. Honeywell Consumer Products Group, a division of Honeywell International Inc. (“Sponsor”) is the sole sponsor of this Sweepstakes. Employees and agents of the Sponsor, and its affiliates, agencies, subsidiaries, distributors, sales representatives, agents, advertising and promotional agencies, and the immediate families (spouse or parent, child or sibling and their spouses) and household members of each are not eligible to participate or win. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void in Alaska, Hawaii and Puerto Rico and wherever prohibited by law.
2. How to Enter: To enter, complete an online Official Entry Form, available at www.cpgraceresults.com ("Web Site") during the Sweepstakes Entry Period. You can submit entry materials online only at the Web Site during the Sweepstakes Entry Period. Entrants must follow the entry instructions and provide complete and accurate information in all of the information fields on the entry form. When your entry is complete, click on the area marked “Enter Now!” Once submitted, an entry cannot be deleted, canceled, or modified. Limit one entry per person/e-mail address/household per day during the Sweepstakes Entry Period. You may enter the Sweepstakes under one e-mail address only. Entries must originate through www.cpgraceresults.com only to be eligible. Enter using only an e-mail address subscribed and registered in your name. In the event of a dispute as to entries submitted by multiple individuals using the same e-mail account, entry will be deemed to have been submitted by the authorized subscriber of the e-mail account used to enter the Sweepstakes at the actual time of entry. The authorized e-mail account subscriber is deemed to be the natural person who is assigned the e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Sponsor is not responsible for lost, late, incomplete, or misdirected entries. Receipt of entries will not be acknowledged. Sponsor reserves the right to terminate early, modify or suspend the Sweepstakes should there be a security breach, fraud or other circumstances affecting the fair administration of the Sweepstakes. In the event of termination, Sponsor will randomly award the prizes from among all entries received prior to action taken by Sponsor.
3. Drawings: One (1) Grand Prize Winner will be selected in a random drawing conducted on or about 1/05/09, under the supervision of Promotion Fulfillment Center, an independent judging organization, from among all eligible entries received during the entire Sweepstakes Entry Period. Twenty Five (25) Monthly Prize winners will be selected in a random drawing from all entries received for each month of the Sweepstakes Entry Period on or about 10/1/08, 11/3/08, 12/1/08 and 1/2/09 from all eligible entries received by 11:59:59 pm EST of the previous month. Non-winning entries will be carried over into subsequent drawings. By participating, entrants agree to abide by and be bound by the Official Rules and by the decisions of the judges, which are final and binding in all matters relating to this Sweepstakes. Potential winners will be notified by U.S. mail within 6-8 weeks of the drawing. Prizes will be mailed approximately 4 weeks after validated. If prize notification or prize is returned as undeliverable, prize will be forfeited and may be awarded to an alternate winner. Odds of winning depend on number of eligible entries received for each drawing.
4. Prizes: One (1) Grand Prize: a 2008 Custom Fram Nordic Boats USA 22’ Blaze Speedboat including Bimini Top, Full Cover, Depth Finder, Open Bow Cover, Sirius Satellite Radio Swim Ladder, Carpet Kit and Extreme Custom Trailer Approximate Retail Value (ARV): $60,000. All insurance, fees (including, but not limited to, acquisition, title, license, and registration, Federal and State taxes), delivery charges, and any other dealer fees and expenses not specifically mentioned herein, are the sole responsibility of the prize winner. One hundred (100) Monthly Prizes (25 per month): a Die Cast Fram® Dragster replica autographed by Cory McClenathan ARV: $100.00 each. Total ARV of All Prizes $70,000. Limit one prize per person/household/e-mail address, except that monthly winners are eligible for Grand Prize. Any difference between stated value and actual value will not be awarded.
5. Conditions: Grand Prize Winner will be required to execute and return an affidavit of eligibility and liability and publicity release (where permitted) within 14 days of notification or prize will be forfeited and an alternate winner will be selected from among remaining eligible entries. Prizes won by eligible minors will be awarded to parent or legal guardian who will be required to sign and return all documentation. All taxes on prizes are the responsibility of the winners. Grand Prize Winner will be required to furnish his/her social security number. By accepting prize, winner consents to the use of his/her name, photo and/or likeness for publicity purposes without further compensation, except where prohibited by law. Prizes are not transferable, except as provided herein. And no prize substitutions will be allowed, except in Sponsor’s sole discretion due to unavailability of featured prize. No cash redemptions. Winners release Sponsor and their respective directors, officers, employees and agents including without limitation, their advertising and promotion agencies, from any and all liability, loss or damage (INCLUDING PERSONAL INJURY AND/OR DEATH) incurred with respect to the awarding, receipt, possession and/or use of any prize or participation in any prize or Sweepstakes related activity, including any travel related thereto. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by and of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries. Sponsor is not responsible for computer system, phone line, hardware, software, or program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. The Sponsor’s failure to enforce any term of these official rules shall not constitute a waiver of that provision.
6. Claiming Prizes: All prize claims are subject to verification by Sponsor. In the event of noncompliance with these official rules, if prize notification or attempted notification is returned as undeliverable, if winner is deemed ineligible for any reason, or a prize winner declines prize offer, prize will be forfeited and an alternate winner may be selected via random drawing. By participating in the Sweepstakes all participants acknowledge compliance with and agree to be bound by these official rules, the decisions of sponsor and/or judges, which are final in all respects, and all federal, state, and local laws and regulations.
7. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Connecticut. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations or the rights and obligations of the Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of Connecticut, without giving effect to any choice of law of conflict of law rules (whether of Connecticut or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Connecticut.
